Last updated: October 2026

1. Identification

This website is operated under the Flowen brand by Kauã Caetano.

Contact: centralflowen@gmail.com

These Terms and Conditions govern the use of the Flowen website and establish the general conditions applicable to the services provided, without prejudice to the specific conditions agreed in each proposal or contract.

2. Services

Flowen provides services related to automation, artificial intelligence, systems development, integrations, digital solutions and other services presented on the website or agreed directly with the client.

The features, deliverables, deadlines, prices and other conditions applicable to each project are defined in the respective proposal or contract.

Information presented on the website is for informational purposes and does not by itself constitute a binding contractual offer.

3. Contracting

Flowen services are contracted through the acceptance of a proposal, contract or another written document agreed between Flowen and the client.

Submitting a form through the website does not automatically constitute the purchase or contracting of a service.

If these Terms conflict with a specific proposal or contract entered into with a client, the conditions of the specific document shall prevail.

4. Payments

Unless otherwise established in the proposal or contract, implementation projects may follow the following payment structure:

50% of the implementation amount at the beginning of the project.

50% before the solution enters production.

Recurring monthly fees begin once the solution enters production unless otherwise agreed in writing.

Prices, payment dates and applicable methods are defined in the corresponding proposal or contract.

5. Recurring services and minimum term

Recurring services subject to a monthly fee have, unless otherwise agreed in writing, a minimum commitment period of 6 months from the date the solution enters production.

After the minimum period, the service may be terminated with at least 30 days' prior notice.

Different conditions may be established in a specific proposal or contract.

6. Monthly service coverage

Where applicable, the monthly fee may include maintenance, monitoring, fixes within the contracted scope, support, minor configuration changes and updates required for existing integrations.

The exact services included are defined in the client's proposal or contract.

7. Additional services

New modules, integrations, automations, significant logic changes, architecture changes, rebuilds or work outside the originally contracted scope may involve additional costs.

Relevant additional work will be communicated to the client in advance.

8. Third party services and costs

Some solutions may depend on platforms, APIs, artificial intelligence services, hosting, telecommunications or other external providers.

Extraordinary costs or significant variable usage of third party services may be charged separately where applicable, following prior notification to the client.

Flowen does not control the availability, pricing changes or operation of third party services.

9. Client responsibilities

The client must provide the information, access, materials and approvals required to execute the project.

Delays caused by the absence of these elements may affect initially estimated deadlines.

The client is responsible for ensuring that it has the necessary rights and authorisations regarding the data, systems and content provided to Flowen.

10. Suspension for non payment

In the event of overdue payments, Flowen may partially or fully suspend services after notifying the client.

Suspension does not remove outstanding payment obligations or other obligations established in the applicable proposal or contract.

11. Intellectual property

Unless otherwise established in the proposal or contract, Flowen retains rights over methodologies, structures, reusable components, technical knowledge and materials previously developed or used generically in its services.

Specific usage rights granted to the client regarding a developed solution are defined in the relevant proposal or contract.

12. Limitation of liability

Flowen seeks to ensure the proper operation of the solutions it provides but cannot guarantee uninterrupted operation of external services, third party platforms, APIs, artificial intelligence providers or infrastructure outside its control.

Flowen is not responsible for interruptions, changes or failures directly caused by external providers, incorrect use of the solution by the client or unauthorised modifications.

13. Website use

Users must not use the website for illegal, abusive or fraudulent activities or in any way that may compromise its operation or security.

Website content may not be commercially reproduced or used without authorisation where protected by applicable rights.

14. Data protection

The processing of personal data through the website is governed by Flowen's Privacy Policy.

15. Changes

Flowen may update these Terms and Conditions when necessary.

The applicable version will be the version published on the website at the relevant time, without prejudice to previously executed contracts.

16. Governing law

These Terms and Conditions are governed by Portuguese law.

Matters relating to contracted services will be handled according to the applicable contract or proposal and applicable law.
